About This Book
This English work is built on ad-Durar al-Bahiyyah fi al-Masa'il al-Fiqhiyyah, a concise fiqh text by Imam Muhammad bin Ali ash-Shawkani. In it, ash-Shawkani set out what he held to be the strongest positions on legal questions, based on authentic evidence and textual reasoning, without binding himself to any one school of fiqh. The Arabic subtitle identifies this volume as a commentary (sharh) on ad-Durar al-Bahiyyah.
The translation follows the Arabic edition published by Dar Ibn Hazm in Beirut, which was reviewed by Shaykh Muhammad Subhi bin Hasan Hallaq, a Yemen-based scholar of hadith and fiqh known for tracing, editing, and publishing ash-Shawkani's manuscripts.
About the Author
Ash-Shawkani came from the Zaydi school and called for a return to the Qur'an and hadith as the sources of law. He regarded himself as a mujtahid, opposed taqlid (following without evidence) for those qualified to exercise ijtihad, and set out study programs for reaching different levels of scholarship. He issued a large number of fatwas, some of which were collected in book form. Many regard him as a reviver, his work influenced later movements such as the Ahl-i Hadith, and his legal discussions are still cited by scholars today.
